Adopted Dog Bite Liability

Christine Pavone, who was battling cancer at the time, wanted to bring some joy back into her family’s life. This led to the adoption of Jaxx from the ACC (Animal Care Centers of NYC). Unbeknownst to them, the adoption would only bring further disaster.

Jaxx’s aggressive disposition soon became obvious. Unprovoked attacks on anyone nearby began as early as the next day. Christine’s son, Anthony Pavone (24) suffered serious injury when the 86-pound boxer pitbull mix removed a chunk of his arm. According to Anthony, the dog intended to go for his throat, but he managed to intercept the attack with his arm. The attack left him traumatized and nervous around any canine.

As a result, Pavone is suing the ACC for neglecting to inform them of the dog’s dangerous tendencies upon purchase. The suit argues the dog was not assessed prior to adoption. In fact, Christine was advised that the dog is friendly.

Millions of people are bitten by dogs every year, the majority being children. Approximately 800,000 seek treatment. While many believe certain breeds are more inclined to bite, each dogs’ individual history strongly determines the potential for hostility. Any dog may attack if provoked enough. However, unprovoked attacks usually come with a history of violence. Typically, this means they’ve bitten someone in the past or have shown an inclination to bite. An aggressive dog would likely have shown signs of this behavior prior to adoption.

Negligence, resulting in a dog bite, isn’t limited to owners. Shelters that are selling canines also have a responsibility to inform potential owners of each pets’ record.
