According to AAA, a strong sense of cabin fever combined with a larger percentage of disposable income will likely lead to a larger contingent of travelers for the upcoming Memorial Day weekend holiday. Even though most New Yorkers have long since gotten over the winter blues, it is expected that more people will take to the roads to head to their favorite vacation spot.

For most people in the Tri-State area, this may mean going to the beach, heading to camp sites or going to an amusement park. With more people on the road, the chances of being involved in an accident increases. Because of this, drivers must be cautious of their surroundings and do their best to use reasonable care while behind the wheel.

Indeed, the term “reasonable care” is a legal term, but it has a very practical application. Essentially, it means that a driver must act as a reasonable, prudent person would; meaning that a driver would take the necessary precautions to drive safely and reasonably in order to avoid an accident. A driver ostensibly does not use reasonable care when he or she drives at unsafe speeds for the circumstances, does not limit distractions (or creates them by talking on a cell phone or texting while driving), or drives while under the influence of alcohol.

If a driver causes an accident because of these things, he or she could be held liable for the accident; meaning that an injured party may sue them for monetary damages based on the driver’s failure to use reasonable care.
